New Labour Market Testing Requirement Introduced for Employer Sponsored Visas in Australia on September 10, 2020

You all might be aware that covid-19 has devastated the economy as a whole, and has a significant impact on the Australian Economy as well. On September 10, 2020, the Australian Government has changed the requirements for the labour market testing for all the employer sponsored visas. If you’ll apply under the Temporary Skill Shortage Visa subclass 482 and Skilled Employer Sponsored Regional (Provisional) Visa Subclass 494, you need to provide the three job advertisements to the concerned authorities, one of which must be placed on the Australia’s Government Jobs Active Website.

Forall the applicants who’ll apply under the subclass 186, employer Nomination Scheme and subclass 187, Regional Sponsored Migration Scheme Visas, the employers must have advertised the position on the Active job Portal on the Job Active Website.

The DHA (Department of Home Affairs) will also be checking the applications of the candidates who’ll apply under the subclass 186 and 187, keeping in mind that if Australian Workers have been:

  • Retrenched in the last 12 months
  • Had Reduced Hours in the last 12 months
  • Had a Reduction in the pay or working conditions in the last 12 months

The DHA will also keep a close check on the terms and conditions of the candidates who hold a temporary work visa and also have a look at whether the recruitment of the temporary visa holders is beyond the casual scope of business or not.

The changes mentioned above apply to all the applications that will be lodged on or after October 1, 2020. The Job advertisements must be in English and must be listed four weeks and should include the following such as:

  • Name of the Australian Employer or recruiter who has placed the advertisement on the job portal
  • Title and the Job Description of the Job Posted
  • The Skill set and the Expertise Requirement
  • Salary (if the annual earnings for the position will be less than $96,000)
